If you were injured in an accident involving an automobile, a motorcycle, truck, a slip and fall or various other circumstances, I will examine your cause. In some cases even workplace injuries may be compensable in addition to the Workers Compensation afforded the injured worker. This area of the law involves civil cases designed to obtain compensation for injury to your person. First, I will evaluate the liability (who was at fault) and the damages (to what degree you were injured.)
I will do this by collecting and compiling your medical records, and contemporaneously gathering all evidence, including the use of private investigators, to prove the fault of the person who caused the injury. Once I have a clearer picture of the nature and extent of your injuries, sometimes I will draft a complete and sometimes complex settlement brochure for submission to the insurance company of the at fault person. Failing this, I will then pursue litigation. At some point during the litigation process we will negotiate with the opposing party, including their insurance company. Many times, mediation is agreed to, and often is successful. If not, we may take your case to trial.
The main concerns in a personal injury case are liability and damages. Before you can collect an award, I will have to prove that the defendant is liable through their negligence. If there is a failure to exercise reasonable care to prevent injury or damage, this may be the case. Once liability has been established, the judge or jury may award money to compensate for medical costs, lost wages and lost future earnings, as well as for loss of enjoyment of life, disfigurement and pain and suffering.
